Case Fresh provides our products to our customers under to the following terms and conditions outlined below. Placing an order / pre-order and, or visiting this website implies acceptance of the following terms and conditions. TERMS OF SALE

Case Fresh's Terms of Sale
All customer orders placed with Case Fresh must be paid within 7 days from the date of the order confirmation / invoice being sent by Case Fresh. No half or part payments will be accepted. Case Fresh does not offer lay-buys or instalment payment options. Failure to make payment within the allocated timeframe will result in order cancellation and the products being returned into stock for sale. Subsequently any pre-order price savings will be void and new orders will only be possible at the in stock price.

Payments for pre-orders are due when the product arrives into stock within 7 days from the date of the order confirmation / invoice being sent by Case Fresh. Case Fresh does not charge in advance for any pre-order unless otherwise specified directly by us next to the item in question.

Customers who cancel orders and /or pre-orders placed with Case Fresh or fail to make payment after submitting orders and / or pre-orders may jeopardise their ability to pre-order and purchase from Case Fresh in the future.

Customers who cancel pre-orders on products that have specified deposits, or fail to pay for their pre-order within the stipulated time frame, will forfeit the deposit in its entirety to Case Fresh. All deposits are non refundable and non transferable.

All products are sold on a first come, first served basis. Products may sell out at any time. Customers will be notified if products in your order are out of stock before the final order confirmation is sent or any changes are applied. Due to supplier allocations some items may only be available in very limited quantities.

Case Fresh reserves the right to limit quantities of individual products on any order placed by customers.

Case Fresh reserves the right to refuse a customer.

Products purchased from Case Fresh are shipped pursuant to our contract with Australia Post. Risk of loss and title for such products pass to you (the customer) upon delivery to the carrier Australia Post. Insurance can be provided and covers the loss and, or destruction of the customer's order only. Customer orders are not automatically insured. This is an optional shipping service and must be requested by the customer when placing their order on the order form provided.

Case Fresh will not be held liable or replace goods and / or costs associated with any orders placed with Case Fresh where the customer has been negligent in not taking out insurance on said order.

Returns Policy and Procedure
Damaged and Faulty Goods:
An item may be returned or exchanged only if the product itself arrives damaged, defective or if the wrong product was shipped. If any product is returned for the above reasons Case Fresh will supply the same said product to the customer if in stock or issue a refund or credit if the product is no longer available.

Returns or exchanges will not be given if the sole reason for return is that the packaging of a product is damaged. Items that are damaged due to negligence or through use for a purpose other than what they are designed for will not be eligible for a return. Items damaged during transit are not eligible for a return and fall under our policy on damage on goods in transit.

Return Procedure:
Customers must contact Case Fresh for issue of an IRA (Inwards Return Advice) before sending any products back to us. You must notify Case Fresh within 21 days of delivery that your item is damaged, defective or the incorrect merchandise. The item must then be dispatched in a timely manner so that it is received by Case Fresh no later than 14 days after the date of authorisation of an IRA.

All returns must be packed properly to avoid possible damage. Customers must ensure they use appropriate packaging materials and a shipping box that is of adequate size and strength for the product to be returned. Where possible customers should send their return back using the original box and packaging materials used by Case Fresh. Returns that do not adhere to these criteria may be rejected “Return to Sender”. Case Fresh reserves the right to refuse returns if there is any doubt to the validity of the customer’s claim.

Items returned to Case Fresh under these conditions are to be shipped as per the directions stated in the authorised IRA. Any items returned using "Return to Sender", "Cash On Delivery (COD)", or any other unauthorised methods will be refused by Case Fresh.

Pricing and Availability
All prices listed on Case Fresh are in Australian Dollars ($AUD) and inclusive of the 10% Australian Goods and Services Tax (GST). All customers both Australian and International are invoiced and charged for orders in Australian Dollars ($AUD).

International customers are exempt from paying the 10% Australian Goods and Services Tax (GST) on products purchased from Case Fresh. This reduces the actual invoice price that international customers will pay. If you are an international customer you can approximate the website price you will pay on the items you wish to order by multiplying the price by 10 and then dividing it by 11.

Case Fresh reserves the right to change the price of any products listed on our website without notice. Case Fresh is not responsible for typographical errors on prices listed on the website. Case Fresh reserves the right to cancel and / or refuse customer orders placed under these circumstances.

Product availability is subject to frequent change. We endeavour to keep our website as up to date as possible, however there may be occasions when products marked as in stock may sell out prior to an order being processed and the website updated. For this reason Case Fresh does not guarantee that all products listed are in stock at the time a customer places an order.

As Case Fresh does not manufacture the products we sell we have no control over the shipping dates listed next to pre-orders and cannot guarantee that these will not change. As we rely on distributors and, or manufacturers to supply our products Case Fresh is not responsible for delays in shipping dates, shortages, supplier allocations, non-supply of product, changes and modifications to or cancellations of products offered for sale by Case Fresh from the distributors and, or manufacturers that we deal with.

Free Shipping
Case Fresh offers Free Shipping on all Australian (domestic) orders and pre-orders of $90 or more. All orders that qualify for Free Shipping are subject to Case Fresh's Free Shipping Terms and Conditions.

Customers will not be eligible for Free Shipping on their order if any eligible items are cancelled, bringing the order total below $90 or if an order of an in stock product is combined with a pre-order product that is not due to ship (arrive into stock) in the same month. Cancelling items, combining orders or changing your shipping address may also affect your orders eligibility for Free Shipping.

Case Fresh reserves the right to modify / change Free Shipping Terms and Conditions and / or discontinue Free Shipping at any time.

Duties, Taxes, Tariffs and Prohibited Goods
All International customers are responsible for all duties, taxes, tariffs and any other fees charged by their country. Please double check with your customs organisations prior to placing an order to ensure you are fully aware of any additional costs that you may incur when you receive your order from Case Fresh.

All products sold by Case Fresh comply with local safety laws and other legal requirements. Case Fresh is not responsible for items shipped to other countries that do not comply with their local laws or safety requirements. International customers are responsible to ensure that any items ordered from Case Fresh comply with all local legislation in their country.

Case Fresh is not responsible for customers orders that are seized by their local customs authority due to the customers non-compliance. Case Fresh will not refund the cost of any goods and, or postage for orders that are seized by customs authorities in their country. Case Fresh will not refund the cost of any goods and, or postage for orders that are abandoned by customers or returned to Case Fresh due to customers not complying with any taxes, duties or tariff levies imposed on them by their country.
